COURT INQUEST AND INVESTIGATION. Employees who witness, but are not involved in an accident while on duty, and as a result are required to make a report of same to the Company, and who are later required to attend court or an inquest by subpoena, or employees who, at the direction of the Company are required to attend court, an inquest or an investigation called by the Company attorney, or employees who are subpoenaed and are required to court or an inquest as a result of an action arising out of carrying out the specific orders of the Company, shall be paid on the following basis: Their regular rate of pay for all such time which in no event shall be less than the amount of actual time lost plus reimbursement for any expenses incurred while making such appearance. Hourly rate employees will not be required to report for duty for any portion of their shift on the day of making such appearance when such appearance occurs during their shift. If an employee would not be able to get reasonable rest before the start of shift, will not be required to report for work on such shift. The reverse shall apply when employee, by working shift, would not receive reasonable rest before required appearance in court. If, however, the employee is already on shift at time of notice to appear, shall continue with shift. Spare board operators shall receive their straight time statutory holiday pay during the day or days they were attending court or an employee takes direct or indirect action against Company, will not be entitled to compensation in accordance with the provisions of this article. When such service is required of employees on their regular assigned days off, operators shall paid at hourly rate for hours so used with a minimum equal to one day’s vacation pay. Spare board operators shall be credited a day’s work for day in such service for purpose of establishing over- time days applicable. Hourly rate employees will be paid for time so spent at their hourly rate with x of eight hours. When court, inquest or investigation is at a point other than the employee’s home ter- xxxxx, shall be provided with trans- portation and reasonable expenses, it being understood that if the Company provides transportation and expenses, and funds to the employee by the courts for transportation and expenses shall he turned over to the Company, Witness fees will be returned to the Company. If the occurs while on vacation, this will be in addition to vacation pay. Jury Duty on jury duty he allowed between the daily compensation they would have earned had they remained on their assignment and the daily amount paid duty Spare board Operators, when so used, shall be paid the difference between their straight time statutory holiday pay and the daily amount for jury duty for each day they are off the for such duty. Bail Bonds employee involved in an accident while engaged in the performance of assigned duties with the Company shall promptly be furnished bond by the Company, when such is required. Any employee shall also have the legal assis- tance of the Company in any legal proceed- ings brought jointly against the employee and the Company, or brought against the as a result of carrying the specific orders of the Company.
