Covenant as to No Investment Company Status. The Company shall use its best efforts, until the [fifth][tenth] anniversary of the Effective Date, to maintain its status that it is not an "investment company" or an entity "controlled" by an "investment company" within the meaning of the Investment Company Act of 1940.
