Covenant Not to Xxx or Participate in Any Other Action. Subject to the Court’s granting of final approval of the settlement contemplated herein, any Final Settlement Class Member shall be forever barred from filing any other action or proceeding or participating either as a named plaintiff or as an unnamed class member in any other lawsuit or class action in any state or federal court or administrative tribunal as permitted by law regarding any of the Released Claims as defined in Section X below.
