Common use of Covenants, Representations and Warranties of the Issuer Clause in Contracts

Covenants, Representations and Warranties of the Issuer. All covenants, representations and warranties of the Issuer in this Indenture are covenants, representations and warranties solely of the Issuer and not covenants, representations and warranties of the Owner Trustee or of the Person acting as Owner Trustee in its individual capacity. The Owner Trustee is entering into this Indenture solely as Owner Trustee and not in its individual capacity, and in no case whatsoever shall the Owner Trustee be personally liable on, or for any loss in respect of, any of the statements, representations, warranties or obligations of the Issuer hereunder, as to all of which the parties hereto agree to look solely to the property of the related Trust Estate.
