Common use of Covenants Without Cure Period Clause in Contracts

Covenants Without Cure Period. (a) Any failure by any Borrower to perform or observe any of its obligations under Section 9.1.2, 9.1.3, 9.1.5, clauses (g), (h), (i), (k)(iv), (k)(v), (k)(vi) or (k)(vii) of Section 11.1.1, 11.1.2(b), 11.1.3, 11.1.6, 11.1.11, 11.1.14, 11.1.17, 11.2.2, 11.2.3, 11.2.5, 11.2.15, 11.2.17 and 11.2.19, which failure, if capable of being cured, remains uncured for a period of five (5) Business Days after the date that any Borrower receives notice or otherwise Knows of such failure; or (b) any failure by any Borrower to perform or observe any of its obligations under Sections 9.2.4, 11.1.1(f), 11.1.2(a), 11.1.9, or 11.2 (other than those clauses of Section 11.2 specified in clause (a) of this Section 12.1.5).

Covenants Without Cure Period. (a) Any failure by any Borrower to perform or observe any of its obligations under Section 9.1.28.1.2, 9.1.38.1.3, 9.1.58.1.4, clauses (e), (f), (g), (hi)(iv), (ii)(v), (k)(iv), (k)(v), (k)(vii)(vi) or (k)(viii)(vii) of Section 11.1.110.1.1, 11.1.2(b10.1.2(b), 11.1.310.1.3, 11.1.610.1.6 , 11.1.1110.1.9, 11.1.1410.1.12, 11.1.1710.2.2, 11.2.210.2.3, 11.2.310.2.4, 11.2.510.2.5, 11.2.1510.2.13, 11.2.17 10.2.14, 10.2.15, 10.2.16 and 11.2.19, 10.2.18 which failure, if capable of being cured, remains uncured for a period of five (5) Business Days after the date that any Borrower receives notice or otherwise Knows of such failure; or (b) any failure by any Borrower to perform or observe any of its obligations under Sections 9.2.48.2.4, 11.1.1(f10.1.1(a), 11.1.2(a), 11.1.910.1.7, or 11.2 10.2 (other than those clauses of Section 11.2 10.2 specified in clause (a) of this Section 12.1.511.1.4).
