Creation of Trust; Name. There is hereby created a Trust which shall be known as “Wachovia Student Loan Trust 20[__]-[__]”, in which name the Eligible Lender Trustee may conduct the business of the Trust, make and execute contracts and other instruments on behalf of the Trust and xxx and be sued.
