Common use of Credit Document Pursuant to Credit Agreement Clause in Contracts

Credit Document Pursuant to Credit Agreement. This Amendment is executed pursuant to the Credit Agreement and shall be construed, administered and applied in accordance with all of the terms and provisions of the Credit Agreement (and, following the Amendment No. 1 Effective Date, the Amended Credit Agreement). Any breach of any representation or warranty or covenant or agreement contained in this Amendment shall be deemed to be an Event of Default for all purposes of the Credit Agreement.

Any breach provisions relating to forum selection, consent to jurisdiction and waiver of any representation or warranty or covenant or agreement contained jury trial included in this Amendment shall be deemed to be an Event of Default for all purposes Sections 11.14, 11.15 and 11.16 of the Credit Agreement, which provisions are hereby acknowledged and confirmed by each of the parties hereto.
