Common use of Credit Prior to Final Payment Clause in Contracts

Credit Prior to Final Payment. In its sole discretion and from time to time, Custodian may credit the Custody Account, prior to actual receipt of final payment thereof, with (a) proceeds from the sale of securities of the Master Fund which it has been instructed to deliver against payment, (b) proceeds from the redemption of securities or other assets in the Custody Account, and (c) income from securities, funds or other assets in the Custody Account. Any such credit shall be conditional upon actual receipt by Custodian of final payment and may be reversed if final payment is not actually received in full. Custodian may, in its sole discretion and from time to time, permit the Master Fund to use funds so credited to its Custody Account in anticipation of actual receipt of final payment. Any funds so used shall constitute an advance subject to Section 3.19 below.
