Common use of Crediting of Costs Clause in Contracts

Crediting of Costs. Lessee shall have the right to credit against any and all payments to Lessor under this Agreement (“Payments”), including without limitation Advance Royalties, Production Royalty and all costs and expenses incurred by Lessee at Lessor’s request in connection with any action to cure, defend or perfect title pursuant to Section 4.4(a) . Such costs and expenses may include, without limitation, those relating to title research, court costs, surveying and attorneys’ fees.
