Criminal Sanctions. 1. A Vendor’s owners and officers must not have a criminal conviction, indictment, charge, or civil judgment issued against them within the past six years or within the time period of the valid Vendor Agreement, this information must be shared with the SA. 2. A Vendor who abuses the Program is subject to prosecution under applicable Federal, State, and local laws. Those who willfully misapply, steal, or fraudulently obtain WIC funds shall be subject to a fine of not more than $25,000 or imprisonment for not more than five (5) years, or both, if the value of funds is $100 or more. If the value of funds is less than $100 then the penalties are a fine of not more than $1,000 or imprisonment for not more than one (1) year, or both. The Agency shall refer cases of suspected program abuse to the appropriate authorities for investigation and prosecution.
