Criteria for Arbitration. If a reference to arbitration is made pursuant to paragraph 3.9, the arbitrator shall be required to determine the changes to the relevant terms which both: (a) most closely satisfy the criteria specified in paragraph 1.1; and (b) have a reasonable prospect of securing approval of the Regulator.
