Culverts and Bridges. Improvements/Upgrades to bridges and culverts may be required prior to commencement of the project. Damage as a result of the Construction Project to a culvert or bridge structure that was not improved or upgraded must be repaired following the project, or sooner if deemed necessary by the County. All modifications or repairs to culverts or bridges shall be designed in accordance with accepted AASHTO and NYSDOT standards by a Professional Engineer licensed to practice in New York State and employed by a Civil Engineering firm appearing on the approved NYS LDSA lists. All damage by the contractor shall be mitigated, either through repair or replacement, by the contractor at his expense to the satisfaction of Steuben County.

Culverts and Bridges. All damage occurring due to Developer’s work upon the Project shall be mitigated, either through repair or replacement, by the Developer at its expense to the satisfaction of Town. Improvements and upgrades to bridges and culverts may be required prior to commencement of the Project as discussed above. If such bridge or culvert was improved or upgraded prior to Project commencement, then the said bridge or culvert shall be, at a minimum, restored to its pre-Project condition and state of repair, including a consideration of its remaining useful life. Culverts and Bridges. Damage induced by the Developer to a culvert or bridge structure must be repaired following the project, or sooner if deemed necessary by the County. All modifications or repairs to culverts or bridges shall be designed in accordance with accepted AASHTO and NYSDOT standards by a Professional Engineer licensed to practice in New York State and employed by an engineering firm appearing on the approved NYS LDSA lists. All damage caused by the Developer shall be mitigated, either through repair or replacement, by the Developer(s), at his expense, to the satisfaction of the County. The Developer(s) shall hire a qualified contractor, to be approved by the County, to perform the repairs. One hundred percent (100%) of the costs for the labor, materials, equipment, design, and construction inspection services (if required, as determined by the County), shall be paid by the Developer(s).

Culverts and Bridges. The Town and the City agree to notify the other of any work performed on any culvert, bridge, or other infrastructure, drainage in nature or otherwise, within the right-of-way of the Shared Road. Said notification shall occur at least six (6) months in advance, and the municipalities shall work together in good faith to address traffic, safety, and other issues stemming from said work. Further, said notification is designed to allow the other municipality to determine if work on the infrastructure is needed on said municipality’s side of the Shared Road. In the event said work is determined necessary, the Town and the City shall work together to determine if the work, overall, can be bid out as one project for cost saving and efficiency purposes. The municipality in charge of bidding out cooperative work under this paragraph shall be determined by agreement on a case-by-case basis, depending on the location, nature and extent of the work contemplated to be performed. In the event of an emergency repair, the discovering municipality shall immediately notify the other municipality of the emergency and initiate an emergency response with the responsibility of the cost to be determined after the fact based on the location and nature of the emergency.
