Common use of Curative Equity Clause in Contracts

Curative Equity. (a) Subject to the limitations set forth in clause (d) below, any holder of Equity Interests of any Borrower or any direct or indirect parent of the Borrower Agent shall have the right to cure (and shall be deemed to have cured) an Event of Default arising out of a breach of any of the financial covenants set forth in Sections 10.3.1 and 10.3.2 (the “Specified Financial Covenants”) if Borrowers receive the cash proceeds of an investment of Curative Equity within ten (10) Business Days after the date on which the financial statements referred to in Sections 10.1.2(a) and (c) are required to be delivered in respect of such fiscal period for which such financial covenant is being measured in accordance with Section 10.1.2.
