Customer agrees to. Provide legal rights-of-way to Company, at no cost to Company, using Company’s standard forms. This includes rights-of-way on Customer’s property and/or third party property and any permits, fees, etc. required to cross public lands;

Customer agrees to a) Designate a representative in its employ to receive instructions in the operation of the Equipment. Such representative shall have authority to carry out recommendations received from Daikin Applied in conjunction with the performance of this Agreement.
b) Allow Daikin Applied to start and stop the Equipment in order to perform services specified in this Agreement.
c) Operate the Equipment in accordance with Daikin Applied instruction and to notify Daikin Applied promptly of any change in the usual operating conditions.
d) Provide reasonable means of access to the Equipment and building.
e) Employ only Daikin Applied personnel or persons authorized by Xxxxxx Applied to perform all work on the Equipment, except for operation of same.
Customer agrees to. For new Products purchased concurrently with ProTek, register the Products with accurate information with NewTek within ten (10) days of delivery of Product to Customer.
Customer agrees to. (a) conduct business in a manner that reflects favorably at all times on the good name, goodwill and reputation of Xxxx Atlantic and BANI; (b) avoid deceptive, misleading or unethical practices that are or might be detrimental to BANI, the Services, or the public; (c) make no false or misleading representations with regard to BAN I or the Services; (d) not publish or employ, or cooperate in the publication or employment of, any misleading or deceptive advertising material with regard to the Services; and (e) make no representations, warranties or guarantees to Subscribers or to the trade with respect to the specifications, features or capabilities of the Services that are inconsistent with the literature distributed by BANI.
Customer agrees to. (i) ensure that its environment complies with all applicable ForeScout published system specifications; (ii) follow ForeScout’s procedures, including those specified herein, when contacting ForeScout Support; (iii) provide ForeScout reasonable access to all necessary information, systems and personnel to resolve Errors; (iv) promptly implement all Software updates and Fixes provided by ForeScout under this Agreement; (v) update Software to its supported versions; and (vi) use reasonable efforts to internally resolve any support questions prior to contacting ForeScout Support.
