Customer Dissatisfaction. Avaya reserves the right to perform Reseller’s field service obligations in any case where a customer has notified Avaya of dissatisfaction with Reseller’s service and Reseller has failed to remedy the problem following notification by Avaya.
Customer Dissatisfaction. Business users: If you are dissatisfied with PORTAL ONE Service, you may terminate this Agreement upon written notice to us within 30 days after the Service Activation Date. If you terminate your service, you may return the equipment acquired or rented from PORTAL ONE in original condition with no scratches or damage and in original packing material. We will issue you a credit equivalent to the amount you paid to PORTAL ONE excluding any long distance charges. You are still responsible for installation fees owed to any third parties.
Customer Dissatisfaction. Either party may terminate this Agreement, upon thirty (30) days’ prior written notice to Client, in the event that the results of ▇▇▇▇▇▇▇▇▇.▇▇▇’s surveys of Client’s Customers (the current form of which is attached as Exhibit I) indicates, in two (2) out of any three (3) consecutive calendar quarters during the Term, that ten percent (10%) or more of such Customers responded “very dissatisfied” with respect to such Customers’ overall evaluation of Client’s services. ▇▇▇▇▇▇▇▇▇.▇▇▇ shall conduct the surveys on a regular basis, shall provide Client with the results of such surveys on a monthly basis, and shall notify Client when the ten percent (10%) threshold was met or surpassed in any quarter; provided further, however, that neither party may terminate this Agreement as aforesaid where such Customer dissatisfaction is in any way attributed to that party’s negligence or failure to perform its obligations under this Agreement.
