Customized Products. Any customized technology projects required to meet Customer’s specific requirements, such as non-standard reporting requirements, system interfaces or enhancements, will be billed to Customer based on the time and materials required to design, develop, test and deliver the project, unless an alternative arrangement is agreed in writing between Customer and Bank.

In this regard, Customer will be entitled to no more than Customer’s pro rata share of any recoveries that Bank is able to obtain, as reasonably determined by Bank. Malawi Local currency will be held in one or more separate cash accounts that the Customer opened with Bank’s Malawi Subcustodian that are in the Customer’s name and payable exclusively by Bank’s Malawi Subcustodian. The Parties agree that the sole manner to publish and confirm the technical documents, drawings, agreements and product standards relating to the Customized Products shall be the standards and requirements published on the ZTE’s supply chain website (▇▇▇▇▇://▇▇▇▇▇▇.▇▇▇.▇▇▇.▇▇/). which shall be signed back to confirm receipt and implemented accordingly by the Supplier.

Any Products that are customized to order, including, but not limited to customized text, images, sizing, shapes, colors, or materials, are not eligible for return or refund once the order has been placed and production has begun. Customized Products. Minor customization of standard product(s) is allowable. Standard Contract Warranty (Section 5.22) will apply to the customized product(s). Standard products must be approved for the contract. Customizations that alter the basic structure or function, or substantially change the appearance of a standard product are not considered minor and will require written approval from the Department prior to order placement. Eligible Users shall verify the following: Standard product is available through GSA offering (if applicable) or on contract. All warranties, services, terms and conditions applicable for standard products on this contract will be honored in writing by the Manufacturer for customized products. Best value for the customized products (prices, item/service quality, terms and conditions) has been documented. Customized products are subject to the end user’s approval following delivery. Items not conforming to customized specifications may be rejected and customers will not be liable for contractor’s cost. If the contractor approves a conforming item for return, the item may be subject to a re- stocking fee, plus freight charges.
