Common use of Daily Forecasts and Nominations Clause in Contracts

Daily Forecasts and Nominations. (a) Each Day, and for each Receipt Point at which the User receives Gas under this Agreement and any other agreement for the transportation of gas between Evoenergy and the User, the User must inform Evoenergy of its Gas requirements (Forecast Requirements) for the next Day (Nomination Day) under all such transportation agreements as follows: (i) forecast of Gas to be withdrawn from the Network in total (Forecast Withdrawals) calculated in accordance with clause 3.2(b) and itemising the following amounts: (A) forecast Gas requirement for Non Daily Metered Volume Delivery Points (which will not include any Reconciliation Amount); and (B) when required in advance of any Day by Evoenergy, the forecast withdrawal at designated Delivery Points, in such manner and in relation to such times as the User and Evoenergy agree; (ii) the total Quantity of Gas which the User intends to deliver or have delivered into the Network or otherwise intends to receive at each Receipt Point from each Shipper, calculated in accordance with clause 3.2(b); and (iii) the Reconciliation Amount determined in accordance with the Retail Market Procedures, provided Evoenergy is not required to accept the Reconciliation Amount as part of the Forecast Requirement unless the total of all Reconciliation Amounts for all Network Users on a Day in the Network equals zero. (b) The User must make Nominations of the components of Forecast Requirements in good faith so that: (i) the Forecast Withdrawal under clause 3.2(a)(i) for all Receipt Points serving the Network is the aggregate amount which the User intends to withdraw from the Network on the Nomination Day under all transportation agreements; and (ii) the total and Shipper Quantities nominated under clause 3.2(a)(ii) are consistent with the Quantities of Gas which the User is entitled to have delivered to the Receipt Point on the Nomination Day, and the Forecast Requirements take into account Evoenergy's Guidance to Users on the Network Minimum Quantity Requirements (described in Annexure 5). (c) For each Day, Evoenergy must advise the User of the Quantity of Gas which the User should plan to deliver or have delivered into the Network at each Receipt Point on a Day in order to enable Evoenergy to: (i) satisfy the User’s Forecast Requirement; and (ii) satisfy any other aggregate needs for the Network (including adjustment for the User’s change in share of linepack) to ensure safe and reliable supply of gas, (Proposed Nomination). (d) Where the User has more than one Shipper at the Receipt Point, the User will apportion the Proposed Nomination between its Shippers and for each Day, the User must advise Evoenergy of the Quantity of Gas which the User intends to deliver or have delivered into the Network or otherwise intends to receive at each Receipt Point from each Shipper (Confirmed Nomination), which total Quantity must equal the quantity advised by Evoenergy under clause 3.2(c). (e) Where the User has only a single Shipper at the Receipt Point, the Proposed Nomination is the User’s Confirmed Nomination. (f) Evoenergy will advise each relevant Shipper of the User’s Confirmed Nomination and each relevant Shipper and Pipeline operator of the aggregate Nomination for the Shipper and Pipeline operator for that Receipt Point.

(g) If the User fails to provide ActewAGL with a valid Forecast Requirement and/or Confirmed Nomination, ActewAGL will determine the User’s Confirmed Nomination based on the User’s Forecast Withdrawal (adjusted for any Reconciliation Amount) for the same Day in
