Common use of Damage by CONTRACTOR Clause in Contracts

Damage by CONTRACTOR. If CONTRACTOR’S employees or subcontractors 43 cause any injury, damage or loss to CITY property, including but not limited to CITY Streets or 44 curbs, CONTRACTOR shall reimburse CITY for CITY’S cost of repairing such injury, damage or 45 loss. Such reimbursement is not in derogation of any right of CITY to be indemnified by 1 CONTRACTOR for any such injury, damage or loss. With the prior written approval of CITY, 2 CONTRACTOR may repair the damage at CONTRACTOR’S sole cost and expense.

Damage by CONTRACTOR. If CONTRACTOR’S ’s employees or 33 subcontractors 43 cause any injury, damage or loss to CITY property, including but not 34 limited to CITY Streets streets or 44 curbscurbs (excepting normal wear and tear), CONTRACTOR shall 35 reimburse CITY for CITY’S ’s cost of repairing such injury, damage or 45 loss. Such 36 reimbursement is not in derogation of any right of CITY to be indemnified by 1 37 CONTRACTOR for any such injury, damage or loss. With the prior written approval of 1 CITY’s Director of Environmental Services, 2 CONTRACTOR may repair the damage at 2 CONTRACTOR’S ’s sole cost and expense.
