Common use of DAMAGE LIABILITY REDUCTION Clause in Contracts

DAMAGE LIABILITY REDUCTION. 20.1 Subject to this Agreement including without limitation clause 21, You, any Joint Renter and any Authorised Driver will receive the benefit of Xxxxxx’s insurance with its insurer for Loss or Damage of the Vehicle and damage to any third-party property, except: (a) any property owned by You (or any friend, relative, associate or passenger); or (b) any property in Your physical or legal control, provided: (c) You have paid the minimum Liability Reduction set out in Rental Vehicle Agreement Part A; (d) there is no Loss or Damage to the Vehicle as a result of a Single Vehicle Rollover; (e) there has not been a Substantial Breach or breach of clause 5.1(c) of this Agreement and You have not caused any other person to have acted in a manner which is a Substantial Breach or breach of clause 5.1(c) of this Agreement; (f) You are not covered under any other policy of insurance; and (g) You have provided such information and assistance as may be requested by Xxxxxx’s Claims department and or its insurer. 20.2 If cover is extended to You by Xxxxxx’s insurer: (a) You authorise Xxxxxx’s insurer, at its sole discretion, to defend or settle any legal proceedings; (b) Xxxxxx’s insurer has the sole conduct of any proceedings; and (c) any such proceedings shall be brought or defended in Your name or the name of the Joint Renter.

DAMAGE LIABILITY REDUCTION. 20.1 Subject to this Agreement including without limitation clause 21, You, any Joint Renter and any Authorised Driver will may choose to receive the benefit of Xxxxxx’s insurance with its insurer for Loss or Damage of the Vehicle and damage to any third-party property, except: (a) any property owned by You (or any friend, relative, associate or passenger); or (b) any property in Your physical or legal control, provided: (c) You have paid the minimum Liability Reduction set out in Rental Vehicle Agreement Part A; (d) there is no Loss or Damage to the Vehicle as a result of a Single Vehicle Rollover; (e) there has not been a Substantial Breach or breach of clause 5.1(c4.1(c) of this Agreement and You have not caused any other person to have acted in a manner which is a Substantial Breach or breach of clause 5.1(c4.1(c) of this Agreement; (f) You are not covered under any other policy of insurance; and (g) You have provided such information and assistance as may be requested by Xxxxxx’s Claims department and or its insurer. 20.2 If cover is extended to You by Xxxxxx’s insurer: (a) You authorise Xxxxxx’s insurer, at its sole discretion, to defend or settle any legal proceedings; (b) Xxxxxx’s insurer has the sole conduct of any proceedings; and (c) any such proceedings shall be brought or defended in Your name or the name of the Joint Renter. 20.3 If You do not accept Xxxxxx’s insurance cover as provided in clause 20.1 of this Agreement, You must provide alternative vehicle insurance that is comparable with Apollo’s insurance cover. If Your insurance cover is not comparable with Xxxxxx’s insuranc e cover, Xxxxxx reserves the right to refuse hire of the Vehicle to You.

If Your insurance cover is not comparable with Xxxxxx’s insurance cover, Xxxxxx reserves the right to refuse hire of the Vehicle to You.

DAMAGE LIABILITY REDUCTION. 20.1 Subject to this Agreement including without limitation clause 21Agreement, You, any Joint Renter and any Authorised Driver will receive the benefit of Xxxxxx’s Cruisin’ insurance with its insurer for Loss or Damage of the Vehicle and damage to any third-third party property, except: (a) any Any property owned by You (or any friend, relative, associate or passenger); or (b) any Any property in Your physical or legal control, provided:; (ci) You have paid the minimum Liability Reduction set out in the Rental Vehicle Agreement Part AAgreement; (dii) there There is no Loss or Damage to the Vehicle as a result of a Single Vehicle RolloverRollover except where Maximum Cover Package has been purchased; (eiii) there There has not been a Substantial Breach breach or breach of sub clause 5.1(c) of this Agreement and You have not caused any other person to have acted in a manner which is a Substantial Breach or a breach of any sub clause 5.1(c) of this Agreement; (fiv) You are not covered under any other policy of insurance; and (gv) You have provided such information and assistance as may be requested by Xxxxxx’s Cruisin’ Claims department Team and or its insurer. 20.2 If cover is extended to You by Xxxxxx’s Cruisin’ insurer: (a) You authorise Xxxxxx’s Cruisin’ insurer, at its sole discretion, to defend or settle any legal proceedings; (b) Xxxxxx’s Cruisin’ insurer has the sole conduct of any proceedings; and (c) any Any such proceedings shall be brought or defended in Your name or the name of the Joint RenterRenter or Authorisation Driver; and You allow Cruisin to claim in Your name under any applicable substitute vehicle insurance, and do everything that may be required to assist Cruisin in making such a claim.

You have provided such information and assistance as may be requested by Xxxxxx’s Claims Accident department and or its insurer. 20.2 If cover is extended to You by Xxxxxx’s insurer: (a) You authorise Xxxxxx’s insurer, at its sole discretion, to defend or settle any legal proceedings; (b) Xxxxxx’s insurer has the sole conduct of any proceedings; and (c) any such proceedings shall be brought or defended in Your name or the name of the Joint Renter.

You have paid the minimum Liability Reduction set out in Rental Vehicle Agreement Part A; (d) ii. there is no Loss or Damage to the Vehicle as a result of a Single Vehicle Rollover; (e) iii. there has not been a Substantial Breach or breach of sub clause 5.1(c) of this Agreement and You have not caused any other person to have acted in a manner which is a Substantial Breach or breach of sub clause 5.1(c) of this Agreement; (f) iv. You are not covered under any other policy of insurance; and (g) v. You have provided such information and assistance as may be requested by XxxxxxDealer’s Claims Accident department and or its insurer. 20.2 If cover is extended to You by Xxxxxx’s insurer: (a) You authorise Xxxxxx’s insurer, at its sole discretion, to defend or settle any legal proceedings; (b) XxxxxxDealer’s insurer has the sole conduct of any proceedings; and; (c) any such proceedings shall be brought or defended in Your name or the name of the Joint Renter.

DAMAGE LIABILITY REDUCTION. 20.1 Subject to this Agreement including without limitation clause 21, You, any Joint Renter and any Authorised Driver will receive the benefit of Xxxxxx’s insurance with its insurer for Loss or Damage of the Vehicle and damage to any third-party property, except: (a) any property owned by You (or any friend, relative, associate or passenger); oror‌ (b) any property in Your physical or legal control, provided: (c) You have paid the minimum Liability Reduction set out in Rental Vehicle Agreement Part A;A;‌ (d) there is no Loss or Damage to the Vehicle as a result of a Single Vehicle Rollover; (e) there has not been a Substantial Breach or breach of clause 5.1(c) of this Agreement and You have not caused any other person to have acted in a manner which is a Substantial Breach or breach of clause 5.1(c) of this Agreement; (f) You are not covered under any other policy of insurance; andand‌ (g) You have provided such information and assistance as may be requested by Xxxxxx’s Claims department and or its insurer. 20.2 If cover is extended to You by Xxxxxx’s insurer:insurer:‌ (a) You authorise Xxxxxx’s insurer, at its sole discretion, to defend or settle any legal proceedings; (b) Xxxxxx’s insurer has the sole conduct of any proceedings; and (c) any such proceedings shall be brought or defended in Your name or the name of the Joint Renter.Renter.‌

You have paid the minimum Liability Reduction set out in Rental Vehicle Agreement Part A; (d) ii. there is no Loss or Damage to the Vehicle as a result of a Single Vehicle Rollover; (e) iii. there has not been a Substantial Breach or breach of sub clause 5.1(c) of this Agreement and You have not caused any other person to have acted in a manner which is a Substantial Breach or breach of sub clause 5.1(c) of this Agreement; (f) iv. You are not covered under any other policy of insurance; and (g) v. You have provided such information and assistance as may be requested by XxxxxxHippie Camper’s Claims Accident department and or its insurer.insurer.‌ 20.2 If cover is extended to You by XxxxxxHippie Camper’s insurer: (a) You authorise XxxxxxHippie Camper’s insurer, at its sole discretion, to defend or settle any legal proceedings; (b) XxxxxxHippie Camper’s insurer has the sole conduct of any proceedings; and; (c) any such proceedings shall be brought or defended in Your name or the name of the Joint Renter.
