DAMAGE OR DESTRUCTION; SHUTDOWN. 13.1 Lessee Repair and Restoration. If, at any time during the Term, the Solar Energy Facility shall be substantially damaged or destroyed and rendered inoperable by fire or other occurrence of any kind, Lessee shall at its sole cost and expense either (a) repair or replace the Permitted Improvements, or (b) elect to terminate this Lease in which case Lessee shall decommission and remove the Permitted Improvements and promptly restore the Premises to substantially the same condition as existed prior to the Effective Date, except as otherwise specified in Section 6.1 of this Lease. Such repair or replacement, including such changes and alterations as aforementioned and including temporary repairs, are referred to in this Article as the “Work.”
