Common use of Damage to Tenant's Property Clause in Contracts

Damage to Tenant's Property. Notwithstanding the provisions of Paragraph 15 to the contrary, Landlord or its agents shall not be liable for any damage to property entrusted to employees of the Complex, nor for loss of or damage to any property by theft or otherwise, nor for any injury or damage to persons or property resulting from fire, explosion, falling plaster, steam, gas, electricity, water or rain which may leak from any part of the Complex or from the pipes, appliances or plumbing works therein or from the roof, street or sub-surface or from any other place or resulting from dampness or any other cause whatsoever, unless the same is caused by the active negligence or willful misconduct of the Landlord. Landlord or its agents shall not be liable for interference with the light or other incorporeal hereditaments, nor shall Landlord be liable for any latent defect in the Premises or in the Complex. Tenant shall give prompt notice to Landlord in case of fire or accidents in the Premises or in the Complex or of defects therein or in the fixtures or equipment.

Damage to Tenant's Property. Notwithstanding Subject to the provisions of Paragraph 15 to Section 20 above and the contraryinsurance provisions of Section 22, Landlord or its agents shall not be liable for (i) any damage to any property entrusted to employees of the ComplexBuilding, nor for (ii) loss of or damage to any property by theft or otherwise, nor for (iii) any injury or damage to persons or property resulting from insurrection, riots, military activity, fire, explosion, falling plaster, steam, gas, electricity, water or rain which may leak from any part of the Complex Building or from the pipes, appliances or plumbing works work therein or from the roof, street or sub-surface subsurface or from any other place or resulting from dampness or any other cause whatsoever, unless the same is caused by the active negligence or willful misconduct of the Landlordexcept as otherwise provided in this Lease. Neither Landlord or nor its agents shall not be liable for any interference with the light or diminution of light, air, view or other incorporeal hereditaments, nor whatever the cause. The occurrence of any such interference or diminution shall not entitle Tenant to any reduction in any rents or charges due Landlord be liable for any latent defect in the Premises or in the Complexhereunder. Tenant shall give prompt notice to Landlord in case of fire or accidents in the Premises or in the Complex Building or of defects therein or in the fixtures or equipmenttherein.

Landlord or its agents shall not be liable for interference with the light or other incorporeal hereditaments, nor shall Landlord be liable for any latent defect in the Premises Premises, Building or in of the ComplexProject. Tenant shall give prompt notice to Landlord in case of fire or accidents in the Premises Premises, Building or in the Complex Project or of defects therein or in the fixtures or equipment.

Notwithstanding the provisions of this Paragraph 15 to the contrary, neither Landlord or nor its agents or employees shall not be liable for any damage to property entrusted to employees of the ComplexTenant’s property, nor for loss of or damage to any property by theft or otherwise, nor for any injury or damage to persons or property resulting from fire, explosion, falling plaster, steam, gas, electricity, water or rain which may leak from any part of the Complex Premises or adjoining buildings or from the pipes, appliances or plumbing works therein or from the roof, street or sub-surface or from any other place or resulting from dampness or any other cause whatsoever, unless the same is caused by the active negligence negligent or willful misconduct of the Landlord. Landlord or its agents shall not be liable for interference with the light or other incorporeal hereditamentsintangible properties, nor shall Landlord be liable for any latent defect in the Premises or in the Complexadjoining properties for the initial twenty-four (24) months of the term of this Lease Agreement. Tenant shall give prompt notice to Landlord in case of fire or accidents in the Premises or in the Complex or of defects therein or in the fixtures or equipment.
