Common use of Damages and Equitable Relief Clause in Contracts

Damages and Equitable Relief. Notwithstanding the provisions of Section 12.2(b) above, nothing contained in this Agreement shall be deemed to limit or restrict the right of any party hereto from seeking such monetary damages and/or equitable remedies (including injunctive relief) as may be available from any court of competent jurisdiction in the event of a breach by any other party or parties of any material covenant on its or their part contained in the Registration Rights Agreement, the Non-Competition and Non-Disclosure Agreement and/or the Employment Agreement.
