Common use of Damages and Losses Clause in Contracts

Damages and Losses. All costs or expenses necessary to replace or repair damages or losses incurred by fire, flood, storm, theft, accident or any other cause not controllable by Contractor and Operator through exercise of reasonable care and diligence in operations and not resulting from Contractor and Operator’s failure to promptly file and diligently pursue claims against insurance companies. Contractor and Operator shall furnish ROC with written notice with details of damages or losses sustained in excess of ten thousand Dollars (US$10,000) per occurrence as soon as practicable.
