Damages Caused By Perils Covered By Insurance. The Owner and the Construction Manager waive all rights against each other, for damages caused by perils covered by insurance provided under section 13.2 to the extent covered by such insurance except such rights as they may have to the proceeds of such insurance held by the Owner and Construction Manager as trustees. The Construction Manager shall require similar waivers from all Subcontractors and their sub- Subcontractors.
