Data Deliverables. 8.1 The Customer supplies Data to Gosling Creative Limited at its own risk and Gosling Creative Limited shall not be liable for any loss or damage to Data. The Customer acknowledges that Gosling Creative Limited may disseminate, split, sectionalise, annotate, highlight, mark or otherwise treat Data in the course of supplying Services. 8.2 The Customer remains at all times responsible for the accuracy of Data and Gosling Creative Limited assumes no responsibility for indicating errors or omissions. Proofs of Deliverables may be submitted by Gosling Creative Limited for Customer’s approval and Gosling Creative Limited shall not be liable for any errors not corrected by the Customer in proofs submitted. Customer’s alterations and additional proofs necessitated thereby shall be charged in addition. Gosling Creative Limited will not be responsible for poor reproduction due to low quality Data or origination supplied by the Customer. 8.3 The Customer warrants that: 8.3.1 the use of Data by Xxxxxxx Creative Limited will not infringe any third party IP Right; and 8.3.2 the Customer has obtained all necessary consent to supply Data to Gosling Creative Limited as required by applicable law. 8.4 Gosling Creative Limited shall deliver the Deliverables and arrange insurance during transit (unless the Customer requests otherwise) and the Customer shall be responsible for such delivery and insurance costs. Any dates specified by Xxxxxxx Creative Limited for delivery are intended to be an estimate and time for delivery shall not be made of the essence by notice. If no dates are so specified, delivery shall be within a reasonable time. 8.5 Risk in the Goods shall pass to the Customer on delivery. 8.6 If for any reason the Customer fails to accept delivery of any of the Deliverables when they are ready for delivery, or Gosling Creative Limited is unable to deliver the Deliverables on time because the Customer has not provided appropriate instructions, documents, licences or authorisations: 8.6.1 risk in the Deliverables shall pass to the Customer (including for loss or damage caused by Gosling Creative Limited’s negligence); 8.6.2 the Deliverables shall be deemed to have been delivered; and 8.6.3 Gosling Creative Limited may store the Deliverables until delivery, whereupon the Customer shall be liable for all related costs and expenses (including, without limitation, storage and insurance). 8.7 Unless the Customer notifies Gosling Creative Limited in writing of a material f...

Data Deliverables. All data shall be submitted as an electronic data deliverable (EDD) in the required unique EDD format(s) for the DoD component(s) or non-DoD customers. The USACE prefers to receive all electronic data in an excel format. All FUDS projects require the use of FUDSChem. Please reference the FUDSChem SOS for CENWO FUDSChem requirements. The Contractor should assume that Air Force Projects will require an Environmental Resources Program Information Management Systems (ERPIMS) database format submission. Contractors shall coordinate data submission requirements with the USACE Project Chemist to ensure all required data are captured and submitted accordingly. Specific EDD requirements shall be developed for each specific contract or task order. Hard copy (PDF) reports must be compliant with a Stage 4 Laboratory Data Deliverable as described in the DoD General Data Validation Guidelines for all method quality objectives required by the DoD QSM that might need to be validated. The electronically and manually reviewed results, including the EDD submissions, are considered to be part of the analytical data package. Failure to meet deliverable deadlines will be considered a failure to meet appropriate standards of project performance. The final data set should reflect the full complement of qualifiers and corrections that result from the dialogue between the Contractor, the Government, and other Stakeholders.
Data Deliverables. All studies, reports and other documentation that Vendor or any Vendor employee, agent or subcontractor creates or develops for CCH or that CCH creates or develops from reporting Services made available to CCH, which are derived from, based on or incorporate data (including CCH Confidential Information or Protected Health Information) resulting from the performance of this Services Agreement, are data deliverables (collectively, “Data Deliverables”) and will be CCH’s property, even if not qualifying as Work Product. CCH will be afforded full access to CCH Data Deliverables at all times, upon reasonable notice. Except as expressly provided otherwise by this Services Agreement, Vendor will be in breach of this Services Agreement if Vendor reproduces, uses or discloses any Data Deliverables, regardless whether such reproduction, use or disclosure is for Vendor’s own or for any third party’s purpose.
Data Deliverables. Electronic data entry by At-Sea Monitors is required in addition to required paperwork, and shall be managed by the contractor in coordination with the COTR. Submission of At-Sea Monitor data to the NMFS shall be accomplished in a timely manner. The contractor shall work with the COTR to establish the appropriate means to transfer the electronic data to the COTR. (a) Delivery of paper log data shall be received within 5 calendar days (120 hours) of the vessel landing as referenced in Section F.5.5. (b) Delivery of electronic data shall be received within 2 calendar days (48 hours) of the vessel landing as referenced in Section F.5.6. (c) Delivery of biological specimens (whole fish samples) shall be received within 5 calendar days (120 hours) of the vessel landing as referenced in Section F.5.7. At-Sea Monitors shall send any written data and biological specimens directly to NMFS. The Government will provide shipping and supplies. At-Sea Monitors shall assure that biological samples or whole animals requiring freezing are received by the nearest NMFS freezer facility within twenty-four (24) hours of vessel landing. NMFS has freezers located in major fishing ports (Section J, Attachment 10, Freezer Locations). The transfer or transport of the frozen samples or animals must be received by NMFS (At-Sea Monitor Training Center) within 5 calendar days of the trip landing, unless a delay is authorized by the COTR. Costs for travel associated with transport of biological samples will be reimbursed under the travel provision section herein (Section B Supplies or Services and Prices/Costs Travel CLINS 0002, 1002 and 2002).

Data Deliverables. Unless specifically requested by Client, ICFA Lab will produce electronic data representing services performed hereunder, subject to the following specific understanding between the parties: ICFA Lab will supply Client with electronic data using a medium as defined by ICFA Lab. Electronic data provided under this agreement is deemed to be the project deliverable for the purpose of fulfilling obligations under the Agreement. Except with regard to any limited warranty as specifically set forth below, ICFA Lab disclaims and excludes all warranties express or implied with regard to the creation, transmittal or use of electronic data hereunder. The limited warranty in this Agreement replaces all other warranties, express or implied, including any warranties of merchantability or fitness for a particular purpose. ICFA Lab's electronic data transfer is derived in part from or is created using third party software, and no such third party warrants or assumes any liability regarding use of or undertakes to provide support information relating to ICFA Lab's electronic data. ICFA Lab will utilize anti-virus programs on a best efforts basis in preparation of the electronic data transfer, but ICFA Lab makes no warranty as to the effectiveness of such screening. In addition to indemnities contained in the underlying agreement between ICFA Lab and Client, Client shall hold ICFA Lab harmless from any claims, suits or liability arising from or related to electronic data supplied pursuant to this Agreement. Any reuse of original or altered files by Client shall be at Client's risk and without liability or responsibility to ICFA Lab, but shall entitle ICFA Lab to additional compensation for such unauthorized reuse. In no event will ICFA Lab's liability for electronic data include any special, incidental or consequential damages, whether or not ICFA Lab has knowledge of the potential for loss or damage.
Data Deliverables a) The Cooperator shall submit the raw data electronically (CD) with the final report. Data shall be submitted in either an Access or Microsoft Excel (preferred) format. This CD shall contain nesting data, banding operation data, survey/resight data, mortality data, and disturbance event data. Should the BR have problems loading the data into the Bases' database, or should the data be incorrectly recorded, the Cooperator will work with the BR to correct the problems. Successful loading of the data must be accomplished by the time the final report is submitted. (1) Data for each nest shall include (but not be limited to): Nest location, Initiation Date, Clutch Size, Eggs Lost Prior to Hatch, # Eggs Hatched, Outcome (Success/Fail), Outcome Date, Cause of Failure, Nest Manipulated (Y/N), Manipulation Type (moved/mounded), Total Distance Moved. (2) Banding data shall include (but not limited to): standard banding data as submitted to the Bird Banding Lab and morphometric measurements taken.
Data Deliverables a. All documents, materials, processes and strategies under this contract shall comply with contract and task order requirements. Where printed deliverables are required, deliverables shall be provided both in paper hardcopy and electronic media formats (including the Internet, i.e., html compatible formats) as determined by the government. The contractor shall be responsible for postage costs for all required mailings. The contractor shall be responsible for ensuring timely delivery of the items to the specific destinations regardless of the delivery method. c. The contractor shall keep the Contracting Officer’s Technical Representative (COTR), informed of task status and progress by regular correspondence or meetings.
