Data Preservation. CLAUSE 5 - SCOPE OF THEFORK'S INTERVENTION TheFork or its contractors cannot perform Maintenance Services in the following situations: ∙ if the Hardware configuration was changed and/or software added that is not compatible with the core software, ; ∙ the use of consumables that are not compatible with the Hardware; ∙ the use of an unsuitable electrical current or defective telephone lines; ∙ faulty air conditioning or fluctuations in the electrical current; ∙ failure of the Restaurateur to comply with this Agreement; ∙ accidents, acts of vandalism, intentional or unintentional negligence, water damage, fire, acts of sabotage or any force majeure event.

Research Data, Digital Research Data and other data, to the extent possible, shall be preserved according to UW’s “Policy on Research Data” (March 24, 2015), which generally provides that data must be “maintained for a period in accordance with all applicable legal requirements and University policies, including: (1) the contractual requirements or federal regulations applicable to any funding that supported the research in which the Research Data were generated; (2) the University’s research misconduct policy; (3) requirements to preserve student records; (4) the Freedom of Information Act and the Wyoming Public Records Act; (5) court orders or subpoenas; (6) reasonably anticipated audits or lawsuits; [and] (7) intellectual property requirements, such as the filing of a patent application.” Data will be stored on a UW file server or PostgreSQL database, ensuring backups, redundancy, and security. UW policy is that beyond the period provided or three years, whichever is longer, and unless other circumstances require longer retention, Data Preservation is the responsibility of the PI and the department or laboratory. Data protection shall be conducted under all federal and State of Wyoming laws and regulations, as well as UW regulations. SER understands that all used and generated data shall be deemed Unlimited Rights Data. In addition, in the cases where the consortium decides to share sets of results/data generated by the project (see additional details on the QuIET open access policy in section 4), the QuIET consortium has decided to transfer these datasets to the ZENODO repository (xxx.xxxxxx.xxx). This online repository is hosted at CERN and was created through the European Commission’s OpenAIRE project with the aim of uniting all the research results arising from EC funded projects. It is an easy-to-use and innovative service that enables researchers based at institutions of all sizes to share results in a wide variety of formats across all fields of science. It uses digital preservation strategies to storage multiple online replicas and backs up data files and metadata on a nightly basis. Data Preservation. In the event of a suspension by XxxXxxxxxx.xxxxx of Customer's access to Services for any reason, during the period of suspension (i) XxxXxxxxxx.xxxxx will not take any action to intentionally erase any Customer data that is stored, processed or transmitted through Customer’s use of the Services or Customer software (collectively, "Data"), and (ii) applicable charges, including Service Data storage charges, if any, will continue to accrue.
