DATA PROVISION. DTPA. The DATA shall be made available to RECIPIENT subject to the PARTIES entering into a Data Transfer and Processing Agreement with the BioMedIT Nodes substantially in the form as specified in Annex III (DTPA).

REPRESENTATIONS AND WARRANTIES Each Party represents to the other Party that: it has obtained all corporate authorisations required to empower it to enter into this Agreement and to perform its obligations hereunder in accordance with its terms; neither the entry into this Agreement nor the obligations contemplated by this Agreement by it shall: violate or conflict with the provisions of its constitutional documents; to its knowledge, amount to a violation or breach of any Applicable Laws or regulations in any relevant jurisdiction; to its knowledge, amount to a violation or default with respect to any relevant order, decree or judgment of any court or any governmental or regulatory authority in any jurisdiction to which it is a Party or by which it is bound, which violation or default is material in the context of the transactions contemplated by this Agreement; or to its knowledge, result in a breach of, or constitute a default under, any instrument to which it is a Party or by which it is bound, which breach or default is material in the context of the transactions contemplated by this Agreement; it is duly incorporated and validly existing under t...

DATA PROVISION. By accepting the terms of this Agreement, the Applicant shall fill in an application form on the company's website, entering the information and data necessary for participation in the Program and provision by the Company of services specified in the PROGRAM SERVICES section. The Applicant undertakes to inform about all changes that have occurred in the previously provided data, such as - family status, education, number of children, etc. The Applicant undertakes to annually send a photo of the Applicant and Program Participants no more than 6 months before each registration in the Program, no later than September 1 each of the year. If the Applicant has provided the Company with the data and information necessary to participate in the Program 10 days before the end of the Program Period, the Applicant and Participants will be registered in the current Program Period, if less than 10 days, then in the next Program Period.
