Common use of Dealings Between Agent and Borrower Clause in Contracts

Dealings Between Agent and Borrower. With respect to its Commitment and the Loans made by it, the Agent shall have the same rights and powers under this Agreement and the other Loan Documents as any other Lender and may exercise the same as though it were not the Agent, and the term "Lender" shall, unless otherwise expressly indicated, include the Agent in its individual capacity. The Agent may accept deposits from, lend money to, act and generally engage in any kind of business with the Borrower and its Subsidiaries, and any Person that may do business with the Borrower or any of its Subsidiaries, all as if the Agent were not the Agent hereunder and without any duty to account therefor to the Lenders.
