Death, Disability, and Retirement Exceptions Sample Clauses
The "Death, Disability, and Retirement Exceptions" clause defines special circumstances under which standard contractual obligations or restrictions may be modified or waived if a party dies, becomes disabled, or retires. In practice, this clause might allow for the early termination of an agreement, the acceleration of certain payments, or the release from non-compete obligations in the event that a key individual is no longer able to fulfill their role due to death, long-term incapacity, or formal retirement. Death, Disability, and Retirement Exceptions. All Participants who become disabled, as defined in Section 1.15, retire, as provided in Subsection 1.14(a), (b), or (c), or die are excepted from any last day or Hours of Service requirement. For purposes of this Section, any Participant who dies while performing qualified military service as defined in Code Section 414(u)(5) will be excepted from any last day or Hours of Service requirement.
