Death, Resignation, or Illness of Arbitrator. a) If an arbitrator dies or resigns from office, another arbitrator shall be appointed in his place pursuant to these International Rules, unless the parties agree otherwise. b) In any case before a sole arbitrator, upon the appointing of the substitute arbitrator, the arbitration shall commence from the beginning, unless the parties agree otherwise. In any case before multiple arbitrators, contemporaneous with the appointment of a substitute arbitrator pursuant to this section, the President shall confer with the other arbitrators to determine whether the arbitration should commence from the beginning. c) In the event of a prolonged illness or other incapacity of an arbitrator that prevents him from carrying out his duties, the President shall (whether upon his own initiative or upon a motion by a party) have the discretion to remove that arbitrator and to appoint another arbitrator in his place pursuant to these International Rules.
