Common use of Debt Due Clause in Contracts

Debt Due. If: (a) the Ministry demands the payment of any Funds or any other money from the Recipient; or (b) the Recipient owes any Funds or any other money to the Ministry, whether or not their return or repayment has been demanded by the Ministry, such Funds or other money shall be deemed to be a debt due and owing to the Ministry by the Recipient, and the Recipient shall pay or return the amount to the Ministry immediately, unless the Ministry directs otherwise.

Debt Due. If: (a) the Ministry demands pursuant to the payment Agreement the repayment of any Funds or any other money from the RecipientGroup; or (b) the Recipient Group owes any Funds or any other money to the Ministry, whether or not their return or repayment payment has been demanded by the Ministry, such Funds or other money shall be deemed to be a debt due and owing to the Ministry by the RecipientGroup, and the Recipient Group shall pay or return the amount to the Ministry immediately, unless the Ministry directs otherwise.
