Common use of Declaration and Termination for Default Clause in Contracts

Declaration and Termination for Default. In addition to other rights identified herein, if Subcontractor has failed to timely respond to a Notice to Cure and/or fails to remedy a breach as required by a Notice to Cure, Contractor may declare Subcontractor in default of the Subcontract, upon further written notice to the Subcontractor. Once a default is declared, no additional notice of breach shall be required. If Subcontractor is in default of its obligations under the Subcontract, the Contractor shall have the option, but not the obligation, to terminate the Subcontract for default.
