Common use of Decreased Costs Clause in Contracts

Decreased Costs. (a) If a Development Entity Change Request results in a decrease in the Development Entity’s costs, then any payment due from the Department under this PPA may be adjusted downwards (or a credit may be owed in the future) to reflect the sharing in the decrease in costs 50:50 as to the Department and the Development Entity, respectively.
