Common use of DEED/MARKETABLE TITLE Clause in Contracts

DEED/MARKETABLE TITLE. Upon performance by Buyers, Seller shall execute and deliver a Limited Warranty Deed, conveying good and marketable title of record to Buyers as tenants in common, subject to only to the following exceptions (collectively, “Permitted Exceptions”): A. Building and zoning laws, ordinances, state and federal regulations; B. Exceptions to title which constitute encumbrances, restrictions, or easements of record; C. Exceptions to title not of record which are disclosed to Buyers and approved by Buyers; D. Matters disclosed in any survey of the Property or which a correct survey of the Property would show; and E. Property Taxes and Assessments.
