Common use of Deemed Refusal of an Allocation Clause in Contracts

Deemed Refusal of an Allocation. When the COUNTY fails to order for delivery within ninety (90) days of the notification of the allocation, any particular individual COMMODITY item that was included in that allocation, PDA may consider that particular individual COMMODITY item refused by the COUNTY and offer the item to other counties participating in the PROGRAM.
