Common use of Default and Specific Performance Clause in Contracts

Default and Specific Performance. The obligations undertaken in this Shareholders’ Agreement are subject to the specific performance by any of the Parties, pursuant to Art. 118, § 3º of Law No. 6.404/76, and the Parties acknowledge that this Shareholders’ Agreement is an instrument enforceable in court for all purposes under Law No. 13.105/15, subject to the provisions of Clause 19 of this Shareholders’ Agreement.

Default and Specific Performance. The obligations undertaken in this Shareholders’ Agreement are subject to the specific performance by any of the Parties, pursuant to Art. 118, § 3º of Law No. 6.404/766,404/76, and the Parties acknowledge that this Shareholders’ Agreement is an instrument enforceable in court for all purposes under Law No. 13.105/1513,105/15, subject to the provisions of Clause 19 of this Shareholders’ Agreement.

Default and Specific Performance.
