DEFAULT BY TENANTS. In the event Tenants are in default of any terms of this Lease or other rules and regulations adopted by the Landlord, said default shall be grounds for termination of the Lease and/or eviction. It is expressly agreed and understood that the Tenants and Co-Signers shall remain liable for all rent until the Lease expires or the Premises are re-leased to other tenants, and shall further remain liable for cleaning costs, trash removal, painting costs, utilities, cost to repair any property damage caused by tenants, any expenses incidental to re-letting, including rental losses, or any other damages and costs sustained by the Landlord by virtue of the Tenants’ use and occupancy of the Premises or default under the Lease.
DEFAULT BY TENANTS. In the event the Tenants fail to pay the rent or any portion thereof when due, and three (3) days notice in writing has been given to Tenants requiring the alternative payment of the rent or possession of the leased premises, the Landlord may, without further notice to terminate the Lease. In the event of said termination by the Landlord for non-payment of rent, the Tenants liability to the Landlord for loss of rent as a result of the vacating of the premises (even if compelled by the Landlord) shall continue until the premises are re-rented to a new tenant. In the event that Tenants shall default in the performance of any of the promises or agreements contained in this Lease, other than the promise to pay rent, or if Tenants shall fail to comply with the Rules and Regulations incorporated herein or hereafter established, the Landlord may give Tenants three (3) days written notice of Landlord's intention to terminate this Lease and at the expiration of the three days the term of this Lease shall end, and Tenants shall surrender the premises to Landlord.
DEFAULT BY TENANTS. Each of the following shall, if not cured within the time periods prescribed herein, constitute an event of default by Tenants:
(1) Basic Rent, Additional Rent, or any other Rent is not paid within ten (10) days of when due;
(2) Tenants fail to comply with any term, provision, covenant, or condition of this Lease;
(3) Tenants fail or are unable to pay its debts generally as they become due; transfer property in fraud of its creditors; make an assignment for the benefit of its creditors; seek the appointment of a receiver or trustee for Tenants’ assets or file for protection under Title 11 of the United States Code (or any statute in replacement or substitution therefor) or any similar state law; and
(4) A receiver or trustee is appointed for Tenants’ assets on the application of a third party or an involuntary petition in bankruptcy is filed against Tenants, in each such case when the same remains undismissed for a period of sixty (60) days.
DEFAULT BY TENANTS. If between the Effective Date and the closing date, one or more tenants aggregating 5,000 or more square feet of space at the Property (not counting the space of RealMark Leasing) vacate the premises or otherwise materially default under their leases, then Purchaser may terminate the Agreement as its only remedy. Said 5,000 square feet shall be reduced, however, by new leases or expansions for additional leased space.
DEFAULT BY TENANTS. Tenant will be in default of their rental agreement when they fail to pay their rental payment when due, or violate any conditions of their agreement, or fail to comply with any federal and state statutes, or any city or county ordinances. Tenants will be in default in the event that Tenants or Tenant’s family, guests or invitees are engaged in any type of drug or criminal activity on the premises. Tenant’s failure to move into the premises, or Tenant’s eviction, abandonment or surrender of the premises, constitutes a default by the tenant. Upon default, rent due for the remaining term of this rental agreement will be accelerated and Tenant will owe the remaining rent and any damages. The Landlord’s retaking of possession of the premises does not constitute a rescission of this rental agreement.
