Defects; No Waiver. Borrower will, upon written demand of Lender, correct or cause to be corrected (a) any material structural defect in the Improvements, and (b) subject to the provisions of Section 7.17 hereof, any material departure from the Plans and Specifications not approved by Lender in writing. The advance of any Loan Proceeds hereunder shall not constitute a waiver of any Lender’s right to require compliance with this covenant.

The advance of any of the proceeds of the Loans hereunder shall not constitute a waiver of the Administrative Agent’s right or the Lenders’ right to require compliance with this covenant.
