Common use of Deficiency in Deadweight Clause in Contracts

Deficiency in Deadweight. If the deadweight (6,500 tons) stipulated in Article II, adjusted for any weight deviances related to Buyer’s Supplies, is not attained and the reduction exceeds 3 % of the stipulated deadweight, the Contract Price shall be reduced by NOK 20,000,- for each ton of the reduction in excess of the said 3 %, but always limited to a maximum of NOK 5,840,000.-. If the reduction in deadweight is more than 7.5 % of the stipulated deadweight Buyer may cancel the Contract.
