Common use of Deficiency in Deadweight Clause in Contracts

Deficiency in Deadweight. If the deadweight (3250 tons) stipulated in Article II, is not attained and the reduction exceeds 8 % of the stipulated deadweight, the Contract Price shall be reduced by NOK 50.000 for each 10 tons of the reduction in excess of the said 8 %, but always limited to a maximum of 16% If the reduction in deadweight is more than 16 % of the stipulated deadweight Buyer may cancel the Contract.

Deficiency in Deadweight. If the deadweight (3250 6,500 tons) stipulated in Article II, adjusted for any weight deviances related to Buyer’s Supplies and Buyer-negotiated equipment packages, is not attained and the reduction exceeds 8 3 % of the stipulated deadweight, the Contract Price shall be reduced by NOK 50.000 20,000.- for each 10 tons ton of the reduction in excess of the said 8 3 %, but always limited to a maximum of 16% NOK 5,840,000.-. If the reduction in deadweight is more than 16 7.5 % of the stipulated deadweight Buyer may cancel the Contract.

Deficiency in Deadweight. If the deadweight (3250 43.000 tons) stipulated in Article II, is not attained and the reduction exceeds 8 % of the stipulated deadweight430 tons, the Contract Price shall be reduced by NOK 50.000 16.000,- for each 10 tons ton of the reduction in excess of the said 8 %430 tons, but always limited to a maximum of 16% NOK 13.700.000,-. If the reduction in deadweight is more than 16 % of 1.290 tons the stipulated deadweight Buyer may cancel the Contract.
