Defined Terms Construction. (a) Unless otherwise defined herein, terms used herein shall have the meaning set forth in Annex A to the Participation Agreement dated as of December 18, 1996 (the "Participation Agreement"), among the Partnership, the General Partner, the Owner Participant, Fleet National Bank (formerly known as Shawmut Bank Connecticut, National Association), a national banking association, not in its individual capacity but solely as owner trustee (in such capacity, the "Owner Trustee") under the Trust Agreement and as Security Agent, First Security Bank, National Association, a national banking association, not in its individual capacity but solely as indenture trustee (in such capacity, the "Indenture Trustee") under the Indenture, Credit Suisse, a bank organized and existing under the laws of Switzerland, acting by and through its New York branch ("Credit Suisse"), as administrative agent (in such capacity, the "Administrative Agent"), and the other entities listed on Schedule I thereto (the "Loan Participants"). Defined terms in this Agreement shall include in the singular number the plural and in the plural number the singular. (b) The words "hereof," "herein" and "hereunder" and words of similar import when used in this Agreement shall, unless otherwise expressly specified, refer to this Agreement as a whole and not to any particular provision of this Agreement and all references to Sections shall be references to Sections of this Agreement unless otherwise expressly specified.
