Common use of Delay Damages Payment Clause in Contracts

Delay Damages Payment. Delay Damages will be billed to the Seller monthly and Seller shall make payment in full within ten (10) business days of date of the billing. Failure to pay these damages as specified will be an Event of Default. Any unpaid amounts will be deducted from any payments to the project prior to disbursement of those payments.
