Common use of Delays and Omissions Clause in Contracts

Delays and Omissions. No course of dealing and no delay or omission by Agent or a Bank in exercising any right or remedy hereunder or with respect to any indebtedness of the Company to Agent or a Bank shall operate as a waiver thereof or of any other right or remedy, and no single or partial exercise thereof shall preclude any other or further exercise thereof or the exercise of any other right or remedy. Agent may remedy any default by the Company hereunder or with respect to any other person, firm or corporation in any reasonable manner without waiving the default remedied and without waiving any other prior or subsequent default by the Company and shall be reimbursed by the Company for its expenses in so remedying such default. All rights and remedies of Agent and the Banks hereunder are cumulative.
