Common use of Deliver to the Port Clause in Contracts

Deliver to the Port. Sixty Percent Drawings for the Port’s approval. The Sixty Percent Drawings shall substantially conform to the Thirty Percent Drawings as ultimately approved by the Port. The Port shall not unreasonably disapprove the Sixty Percent Drawings, and the bases for approval or conditions shall be limited to information not reasonably reflected in the Thirty Percent Drawings. Approval or disapproval shall be communicated within twenty- one (21) days following receipt by the Port in the manner provided for notices, and disapproval shall be accompanied by specification of the grounds for disapproval. Following the Port’s first or any subsequent disapproval, Tenant shall submit revised Sixty Percent Drawings.
