Common use of Deliveries to Escrow Clause in Contracts

Deliveries to Escrow. Prior to the Closing Date, each party shall timely deliver to Escrow all funds and documents required to complete the Closing under the terms of this Agreement, including, but not limited to, prorated amounts and other payments required under Sections 3.7 and 3.8. Failure by a party to make any such delivery shall constitute a material default by such party hereunder.
