Common use of Deliveries to Mezzanine Lender Clause in Contracts

Deliveries to Mezzanine Lender. Not less than thirty (30) days prior to (or, in the case of the transactions described in Section 8.5, promptly following) the closing of any transaction that requires consent of Mezzanine Lender under the provisions of Sections 8.1, 8.3 and 8.5, Mezzanine Borrower shall deliver or cause Mortgage Borrower to deliver to Mezzanine Lender an Officer’s Certificate describing the proposed transaction and stating that such transaction is permitted by this Article VIII, together with any appraisal or other documents upon which such Officer’s Certificate is based. In addition, Mezzanine Borrower shall provide or cause Mortgage Borrower to provide Mezzanine Lender with copies of executed deeds or other similar closing documents within ten (10) Business Days after such closing.
