Delivery and Accuracy. While ATB Financial endeavors to provide Alerts in a timely manner and with accurate information, ATB Financial provides no guarantee as to the delivery or accuracy of the contents of the Alerts, and the Client agrees that ATB Financial will not be liable for Alerts sent pursuant to the Alerts service, including but not limited to, for any errors in the content of any Alert or for any actions taken or not taken by the Client or any third party in reliance of an Alert. ATB Financial will not be liable if any of the Alerts that are sent are intercepted or accessed by someone else, if the privacy or security of the information contained within any Alert is compromised or if the Alerts are delayed or not delivered due to factors beyond ATB Financial’s reasonable control.

We provide trial licenses of the Software for testing and pre-acceptance before purchase and therefore, delivery is deemed complete and accepted when such Software is made available to you. The Depositary shall also provide or make available to Holders copies of such reports when furnished by the Company pursuant to Section 5.6 of the Deposit Agreement. The Registrar shall keep books for the registration of ADSs which at all reasonable times shall be open for inspection by the Company and by the Holders of such ADSs, provided that such inspection shall not be, to the Registrar’s knowledge, for the purpose of communicating with Holders of such ADSs in the interest of a business or object other than the business of the Company or other than a matter related to the Deposit Agreement or the ADSs. The Registrar may close the transfer books with respect to the ADSs, at any time or from time to time, when deemed necessary or advisable by it in good faith in connection with the performance of its duties hereunder, or at the reasonable written request of the Company subject, in all cases, to paragraph (25) and Section 7.8(a) of the Deposit Agreement.
