Common use of Delivery of Assets to Custodian Clause in Contracts

Delivery of Assets to Custodian. Provided they are acceptable to Custodian, the Fund shall deliver to or give Custodian control of the securities, funds and other assets of the Fund, including (a) any payments of income, payments of principal and capital distributions received by the Fund with respect to its securities, funds or other assets at any time during the term of this Agreement, and (b) funds received by the Fund from the sale, at any time during such term, of limited partnership interests in the Fund. Custodian shall not be under any duty or obligation to require the Fund to deliver to it, or to give it control of, any securities or other assets owned by the Fund and shall have no responsibility or liability for or on account of securities or other assets not so delivered or made subject to its control.
