Common use of Delivery of Documents to the Holders Clause in Contracts

Delivery of Documents to the Holders. Each Holder shall have received on or before the Closing Date the following, each in form and substance satisfactory to such Holder and, unless indicated otherwise, dated the Closing Date: (1) this Agreement, duly executed by each of the Obligors; (2) a Note payable to the order of such Holder, duly executed by the Issuer; and (3) the Warrant or Warrants issuable to such Holder hereunder, in each case duly executed by the Issuer.
