Common use of Delivery of Merchandise Clause in Contracts

Delivery of Merchandise. Delivery of Merchandise required by the Agreement must be made in the quantities specified by University. Unless otherwise agreed upon in writing, all Merchandise under the Agreement shall be delivered to the address specified in the Purchase Order (the “Delivery Point”), during University’ normal business hours, DDP (Incoterms 2010) or FOB Delivery Point, as applicable. Supplier shall pack all Merchandise for shipment according to University’s instructions or, if there are no instructions, in a manner sufficient to ensure that the Merchandise is delivered in undamaged condition.
