Delivery of Transferred Mortgage Loan Files; Reimbursement of Advances. (a) The Servicer, the Seller and the Master Servicer hereby acknowledge and agree that with respect to any provisions of this Agreement relating to duties or obligations of a Prior Servicer, the Master Servicer and the Seller shall use commercially reasonable efforts to cause such Prior Servicer to fulfill such duties and obligations, but shall not be liable to the Special Servicer for any Prior Servicer’s failure to fulfill such duties and obligations.
